Section 1

Agreement and scope

These Terms of Use are an agreement between you and One Green Apple, Inc. and apply when you access or use the OPUS platform, mobile application, websites, and related services.

By accessing or using OPUS, you agree to follow these Terms. If you do not agree, you should not use OPUS.

Your school or school district may also have an agreement with One Green Apple or policies that apply to your use of OPUS. Those agreements and policies may include additional requirements.

Section 2

Authorized access

OPUS is intended for users who have been authorized by a participating school, school district, parent or guardian, or One Green Apple.

You may access only the accounts, students, records, messages, and features that you are authorized to access. You may not use another person's account or attempt to obtain access to information that is not intended for you.

Users who are minors may use OPUS only with the authorization or permission required by their parent, guardian, school, or school district.

Section 3

Accounts and security

You are responsible for maintaining the confidentiality of your login credentials and for activity that occurs through your account.

You agree to:

  • Provide accurate account and contact information.
  • Keep your password and sign-in information secure.
  • Not share your account with an unauthorized person.
  • Notify One Green Apple promptly if you suspect unauthorized access or misuse of your account.
Section 4

Acceptable use

You must use OPUS lawfully, respectfully, and in accordance with applicable school or district policies.

You may not use OPUS to:

  • Harass, threaten, bully, intimidate, abuse, or discriminate against another person.
  • Send or share sexually explicit, obscene, violent, unlawful, fraudulent, or otherwise inappropriate content.
  • Impersonate another person or misrepresent your identity.
  • Share another person's private or confidential information without authorization.
  • Access or attempt to access accounts, students, records, messages, or systems without permission.
  • Send spam, malware, commercial solicitations, or misleading content.
  • Interfere with, damage, reverse engineer, bypass, or misuse the OPUS service or its security features.
Section 5

Messages and user content

You are responsible for the messages, files, and other content you submit through OPUS.

You retain any rights you have in your content. You give One Green Apple permission to store, process, transmit, display, and review that content only as reasonably necessary to provide, maintain, secure, and support OPUS and to comply with applicable law and authorized school or district requirements.

Messages sent through OPUS may be associated with your account and may be available to authorized recipients, school or district personnel, or One Green Apple when necessary to provide support, investigate a report, protect users, or operate the service.

Section 6

Reporting, blocking, and moderation

You may report messages that you believe are inappropriate, abusive, threatening, unlawful, or inconsistent with these Terms. One Green Apple and, when appropriate, authorized school or district personnel may review reported content and related information.

One Green Apple may remove content, limit messaging privileges, restrict access, suspend an account, or take other reasonable action when necessary to protect users, participating schools, the OPUS service, or the public.

OPUS may also allow you to block another user. Blocking may limit direct communications from that user but may not prevent official, administrative, safety-related, or school-required communications.

Section 7

School-provided information

Attendance, grades, assignments, schedules, student records, contact information, and other school-related information displayed in OPUS may be provided or maintained by your school, school district, or another authorized system.

One Green Apple can assist with technical problems or how information appears in OPUS. Questions about the accuracy, meaning, or correction of an underlying school record should be directed to the appropriate school or district.

Section 8

Privacy

Our collection, use, sharing, retention, and protection of information is described in the OPUS Privacy Policy.

By using OPUS, you acknowledge that information may be processed as described in that policy and as authorized by participating schools or school districts.

Section 9

Service availability and ownership

OPUS may occasionally be unavailable because of maintenance, updates, connectivity problems, school-system availability, security concerns, or circumstances beyond our control.

One Green Apple owns or licenses the OPUS software, design, documentation, names, logos, and related materials. These Terms do not transfer ownership of those materials to you.

Schools, districts, and users retain their rights in information and content they lawfully provide through OPUS.

Section 10

Account restrictions, termination, and deletion

One Green Apple or a participating school or district may limit, suspend, or terminate access to OPUS because of a violation of these Terms, unauthorized access, harmful conduct, a security risk, a school or district request, or the end of the school's OPUS service.

You may initiate deletion of your OPUS account through the option provided in the mobile application.

Deleting an OPUS account does not necessarily delete student records or other information maintained by a school or district, or information that must be retained for legal, security, contractual, or operational purposes.

Section 11

No emergency services, disclaimers, and liability

OPUS and One Green Apple Support are not emergency services. Do not use OPUS to request emergency assistance. If someone is in immediate danger, call 911 or the applicable local emergency number. For an urgent school safety concern, also contact the appropriate school or district personnel.

OPUS is provided as a communication and information service. To the extent permitted by law, One Green Apple does not guarantee that OPUS will always be uninterrupted, error-free, or that all school-provided information will be complete or accurate.

To the extent permitted by applicable law, One Green Apple's liability for claims arising from your use of OPUS will be limited to direct damages. One Green Apple will not be responsible for indirect, incidental, special, consequential, or punitive damages.

Some laws do not allow certain disclaimers or limitations. In those cases, the applicable limitation will apply only to the maximum extent permitted by law.

Section 12

Changes, governing law, and contact

We may update these Terms from time to time. When we make changes, we will update the effective or last-updated date and may provide additional notice through OPUS, email, a participating school or district, or another reasonable method.

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law rules, except where applicable law requires otherwise.

Questions about these Terms may be sent to support@onegreenapple.com .
